What You Need To Know
The process of submitting a government or corporate fraud report is approximately a six step process as per How it Works, although some pieces can vary case to case.
1. Submit the appropriate fraud report to OffRecord. You can learn more about each of the various types of abuse to report on the home screen. When in doubt about which to submit, simply choose "Other" and OffRecord will ensure it is directed to the appropriate individuals.
2. OffRecord reviews and responds within 48 working hours whether it feels this may or may not be a case that OffRecord believes is worthy of pursuing further. The company will respond in a form in which you have suggested - phone, email or fax and share it's preliminary findings.
3. If OffRecord believes the case has merit in taking further, OffRecord will ask the individaul to sign an engagement letter. OffRecord then ensures that all references to the individual reporting the violation are cleared from all documents where appropriate and speaks with the appropriate legal counsel regarding the case to ascertain their interest in leading the case.
4. Once engaged, OffRecord works with the lawyers throughout the process working to bring the case to closure. If evidence is clear and compelling, many of these cases settle without ever going to court. Either way, OffRecord will work on the case with attorneys taking it through to the completion of the trial, working to achieve the highest reward outcome for recipient, in the shortest period of time possible. However, these trials follow a timeline and course of their own, and no two are the same.
5. If the suit is won the judge will ascertain fees paid to the attorney. These are generally over and above the settlement rewards amount, and unless we agree to pay the attorney a portion of the overall settlement (which we will work to avoid) then the attorney receives none of that amount. OffRecord and the attorneys will work on a contingency basis, which means they are only paid if the case is won. OffRecord will work to minimize all fees beyond the attorney, but should any arise, they will subtracted from the settlement amount.
6. If the case is won, the judge will decide in his full discretion what percentage of the money saved by the government will be rewarded to the individuals presenting the case to the court. This amount can vary anywhere from 15% to 30% of the money saved, and future years can be included when judging the amount saved. OffRecord will divide the settlement amount with the individual, and will, if desired by the individual, work to find a confidential manner in which to pay the person who has reported the violation through OffRecord, although the individual will be responsible for tax reporting and maintaining confidentiality on their side.
