Assuming the Department of Justice has handed the case back to us, or even if the DOJ takes the lead, OffRecord then stays in contact with the lawyers throughout the process in an effort to bring the case to a legally successful conclusion. If evidence is clear and compelling, some of these cases may settle without ever going to court. But the DOJ will have a say as to whether they are satisfied with the direction of the settlement in both situations in a False Claims Lawsuit (ie if they take the suit as lead, or if they allow us to seek independent counsel) and will have some voice as OffRecord works to bring it to closure in a settlement or a final hearing. Either way, OffRecord will work on the case with attorneys taking it through to the completion of the trial, working to achieve the highest reward possible in the shortest period of time. However, these trials follow a timeline and course of their own, and no two are the same - so it is not reasonable to assume one can accurately predict how long the process will take, or the reward amount which the judge will award. It is not unusual however, for these cases to take several years from begining to end.
Different legal teams are better for diffferent types of cases. OffRecord will work to secure the litigation team which is best suited for your particular case. Additionally, as we are on the same side of the table as you, we will look to attract the right firm based all elements that matter - availability, expertise, focus, costs and responsiveness. It is worth noting that many firms will take these cases without accepting a portion of the potential reward, as judges are in general required to award the representing lawyers a fee which is paid by the defendant, over and above the reward paid to the whistleblower.
