The Department of Justice Primer below states the following points about awards for those that relate information in accordance with the False Claims Act:
"If the government intervenes in the qui tam action, the relator is entitled to receive between 15 and 25 percent of the amount recovered by the government through the qui tam action. (This effectively means the DOJ assumes the case and will go after the perpetrators directly). If the government declines to intervene in the action, the relator’s share is increased to 25 to 30 percent. Under certain circumstances, the relator’s share may be reduced to no more than ten percent. If the relator planned and initiated the fraud, the court may reduce the award without limitation. The relator’s share is paid to the relator by the government out of the payment received by the government from the defendant. If a qui tam action is successful, the relator also is entitled to legal fees and other expenses of the action by the defendant. The FCA also provides that if the government chooses to obtain a recovery from the defendant in certain types of proceedings other than the relator’s FCA suit, this is known as an alternate remedy and the relator is entitled to the same share of the recovery as if the recovery was obtained through the relator’s FCA suit. (This means that if the case brought to the courts by the relator find evidence for a new crime, perhaps completely unrelated to the one initially brought to the court, the person bringing the suit to the Government is also responsible for providing a reward in these circumstances as well.)"
Once the judge determines the amount to be paid in settlement, OffRecord will divide that amount confidentially with the individual who has brought the claim and evidence to OffRecord. Both parties will be responsible for their own taxes, but OffRecord will continue to work as confidentially as possible to ensure the individual is paid in accordance with the agreement.
