During the initial investigation period of 48 working hours, barring extenuating circumstances, or an extension of time agreed to by yourself for OffRecord, you agree not to share the information and/or evidence disclosed to OffRecord to any other person or entity. Confidentiality is of utmost importance to OffRecord. By disclosing your information to OffRecord, you waive your right to make a protected disclosure during the time that OffRecord is investigating the claim. The False Claims Act allows a person to make a protected disclosure to a Congressman, etc. without being charged without criminal liability.

You are responsible for providing OffRecord with a full and accurate disclosure of all facts known to you. You can provide OffRecord with any and all evidence in your possession which substantiates your claim at this time, or if you prefer, you can share the detailed evidence once the full contract has been signed by yourself and OffRecord.
Oftentimes, people that are presenting these cases are basing their claim on hunches and beliefs, rather than on factual evidence and proof.

You understand that OffRecord unilaterally has the ability to decline further pursuit of your claim on your behalf, if it determines that not enough evidence exists to prove the claim.
If OffRecord or its agents discovers any misrepresentations you have made concerning the claim, at any time during their investigation, OffRecord reserves the right to end its investigation of your claim.

If OffRecord decides not to further investigate your claim, your information and evidence will be returned to you and OffRecord will destroy any and all evidence of receipt of same to the best of its ability.

You understand that during the period of investigation and prior to the filing of the qui tam action pursuant to the False Claims Act by OffRecord, there will be no recovery if someone else files first and a successful resolution is obtained. If someone files first, but is unsuccessful, it is possible to subsequently file, so long as the facts of fraud are more specific. Furthermore, you are aware that the statute of limitations continues to run until an action is filed, absent any tolling of the statute of limitations. OffRecord does not warrant that the qui tam action will be successful, that the government will intervene (as this only happens in approximately 25% of the cases).  Further, OffRecord does not warrant that all qui tam actions will be pursued to trial; there may be instances where the law firm(s) hired by OffRecord is(are) unwilling to continue with the litigation after the Department of Justice has chosen not to intervene, or determines that the costs of further litigation does not justify denial of the settlement offered  by the defendant(s).

Results may vary, as settlement and/or trial awards are dependent on many factors, eg. 1) The specificity of the information detailing the fraud/ability to prove elements of the fraud; 2) The competency of the attorneys; 3) that the statute of limitations has run, to name a few.

Confidentiality is our priority.

OffRecord is committed to protecting your privacy and any information you submit to us in order that we may evaluate your claim. We will encrypt the information you submit to us using secure socket layer (SSL).  In addition, we strongly suggest that you use a secure browser when filling out OffRecord’s short or long form. For example, you can download www.TorProject.org for free, then access OffRecord’s website. Tor is a network of virtual tunnels that allows people and groups to improve their privacy and security on the internet. We work hard to protect OffRecord and our users from unauthorized access to or unauthorized alteration, disclosure or destruction of information. We review our information collection, storage and processing practices, including physical security measures, to guard against unauthorized access to systems. No method of transmission over the internet, or method of electronic storage, is 100% secure, however.  Therefore, while we aim to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

Use of your personal information.

OffRecord will use the information you provide us to determine the viability of your claim.  We also use your personal information to communicate with you in order to further evaluate your claim.

Only necessary third party disclosure.

In order for OffRecord to investigate your claim, we may need to disclose the information you provide us to certain third parties, ie. attorneys, accountants, or other professionals for the sole purpose of evaluating your claim and to offer further services in connection with your claim. Those service providers will be permitted to obtain only the personal information they need to deliver the service. They are required to maintain the confidentiality of the information and are prohibited from using it for any other purpose than for delivering the service to OffRecord in accordance with OffRecord’s instructions and policies and this Privacy Policy. Please note that if OffRecord sells all or a portion of its business or assets, OffRecord reserves the right to transfer customer information to the acquirer as a part of that acquisition. OffRecord will require that the acquirer maintain the confidentiality of the information consistent with this Privacy Policy. By furnishing any such information to us, you expressly consent to the use of your information in accordance with the terms of this Privacy Policy.

Apart from this, Off Record will disclose personal information only when we have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial request, as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on our website (b) enforce applicable terms of use or other contract rights, including investigation of potential violations thereof, or (c) detect, prevent, or otherwise address fraud, security or technical issues (including abuse of our products or services by spamming or other abuses of netiquette, and use of our products or services to attack other systems or gain unauthorized access to any other system).

OffRecord does not use cookies or other forms of identification to track visitors on its website.
